More ebay hassles

    I just want to cancel my account now.

    This time it was my fault but its still annoying.

    I sold a cable which the photo clearly showed it was a scart to 3 RCA Phono to Scart.

    However I made a mistake on the title and said Phono to 3 RCA.

    I informed the winner of this and she said it was fine so I went away and posted it. Then a few hours later she said its a scart to scart she wanted.

    The ebay add never said that it was a scart to scart and the picture clearly showed it wasn't.

    This was a very heavy and expensive cable so I am not talking about a cheap £1 thing here.

    What should I do? As far as I can tell we are both in the wrong, I made a mistake, but I never claimed it was a scart to scart which she later said she wanted.

    What is the legal situation here? The problem is delivery is £4 so its going to be quite expensive if she wants a refund.

    I would think that ebay would have to support you, as you clearly did not mention scart in your advert. She cannot read and should return the cable to you at HER cost.

    Thanks it was in the scart section though, but it is a scart lead, its just one end has 3 Phono leads rather than a scart.

    I think the law may say we are both in the wrong.

    I advertised a van, but was selling an estate, I tell her this she says its fine, then says actually I wanted a car.

    Thats true :) My mum reckons I am in the wrong but I am not too sure.

    I will wait till her to contact me anyway.

    If at no point did your photo or listing description indicate "scart to scart", do not admit any liability (sounds very insurance company-like!) to this lady, as you're not in the wrong. Do you still have your e-mail to her (and reply from her) regarding you clarifying the description?

    It was in the Scart section (I would imagine) because it had a scart ON ONE END.

    I suppose it depends on whether you ever intend to sell on ebay again. If not, you have nothing to lose by doing nothing. It is unlikely she would take legal action which i reckon she would lose. Ebay don't seem to give a toss about their users so I would not worry from that side. If you want to keep your rating, I would suggest £4 is not a lot, or you could agree with the buyer that you were both at fault and split the postage. She paid for it to her, you will pay for its return.

    Offer to refund her money if she returns the goods. If she won't and leaves you negative feedback, leave her negative feedback. I've had a couple of negatives from tossers, and most people seem to find it part of the ebay experience.

    Yep the other thing I did wrong was I only spotted the third email until I after I sent it as I get 100 spam emails a day on that account.

    However it was 7 hours later when she sent that email. If she contacts me then I will offer her a full refund but offer to split the first postage fee 50/50.

    I don't care too much about my rating as I don't think I will use it again, there is too many sellers and not enough buyers these days.

    IMO think of eBay as a funky Exchange & Mart with a feedback system - suddenly you dont feel quite so keen to see eBay as the problem - the people are the problem ( or at least some of them. At the end of the day - if she paid and you're willing to refund then insist she must pay for P&P both ways otherwise no refund - then brace yourself to receive a negative feedback.

    It's difficult to see how anyone manages to maintain 100% positive beyond 100 deals IMO. I'd also add the c*nt who left me an undeserved negative which spoilt my lovely, but never to return 100% is slowly paying the price. I'm vindictive yes, but in a subtle and very long term way. Nothing serious just a persistent and never ending minor misery.
