job advice

i have been offered a job recently but am unsure whether to accept as im not sure how proffessionally the company is run.

its for a business that puts up racking across the uk, my wages would be payed into my bank weekly, they would supply a company van and the tools to do the job.

however i wont actually be an employee of the company, i would have to register as self employed and work as a subcontractor for him.

This sounds to me like he just wants to get out of paying holiday/sickness pay, he could just get rid of me whenever he wants, and he is trying to escape liability of my actions and responsibility for my health and safetly etc

what do you guys think? are there any other implications i havent thought of? is this legal?

It sounds a bit like that to me too, you would have to arange your own pension and they could fire you and you would have no rights as you would be self employed.

You would think any reputated company would do it all properly and fill in the P5 forms so you're a proper employee with rights.
 
Given the ton weight of legislation that falls on your head the moment you 'employ' someone these days, I can quite see why companies and even individuals who want to start a business are starting to operate this way. Small companies and individuals just can't afford the cost of obeying the legislation. They either operate illegally and hope for the best or they employ contractors. I think we will see a lot more of this sort of setup in the future.
The blame for this idiotic situation is about a 50/50 split between our stupid government and the European Commission and between them they are destroying enterprise in this country (and much of Europe). Only large companies can afford to start anything new these days and that's very bad for progress.
 
I think it depends what the budget is etc, if and when I setup my own company I will be employing people officialy as employees increase the companies value and are one of the most important assets.

However I do see why people would want to only take people on as self employed, the small company I work for do it all officaly however its contract based so I never know when I have a job or not. I am hoping they will renew my contract in a few weeks time.

The legistration is very stupid, it costs more companies £100's in lawyers fees to have contracts drawn up etc.
